Terms and Conditions - Legal - Shipping

All Prices, Policies, and Terms:	Fire Mountain Solar may revise all Prices, Policies, and Terms without notice by updating Fire Mountain Solar's website.
Payment Terms:	VISA, MASTERCARD OR DISCOVER cards, personal or cashier's check, or money order. All shipments outside of the United States must be paid by money order or cashier's check; no credit cards. All checks must clear prior to shipment of orders. Any orders where checks are returned for NSF or Stop Payment Check will be denied, and all future orders will be on credit card basis only.
Freight:	Unless otherwise noted, freight and shipping fees will be charged for shipments to a Customer's designated shipping address, anywhere in the contiguous United States, using a carrier of our choice, will be added to the invoice. Other terms apply to Alaska, Hawaii, Puerto Rico, and export orders. Contact Fire Mountain Solar for further information. Any extra charges incurred for additional services, such as special handling by a carrier, must be paid by the customer. Title and risk of loss pass to customer upon tender of the shipment to the common carrier. If product is damaged in transit, customer must file claim with the carrier. FREIGHT ACCEPTANCE POLICY It is almost impossible to collect money for any freight damage after you have signed the delivery bill. Signing is accepting the article in perfect condition. It is the customer's responsibility to inspect the freight for any damages before signing the delivery bill. We suggest that you remove the shipping carton to verify the condition of the article before you sign the delivery bill. When you sign the delivery receipt, you have accepted the article to be in perfect condition. If any damage is present, note any acceptable damage on the delivery bill when signing for the freight. When possible take pictures. We can then assist you in filing a freight damage claim. If the damage is too severe, refuse the freight and notify us immediately. If someone else is accepting your freight, please advise them of this responsibility. Be sure, before you sign!
Return Policy:	You may return any defective item by shipping it back within 30 days of the day you actually receive it. All orders returned that are not defective will be charged a 15% restocking fee in addition to freight charges. All refused items will be charged the amount for shipping both ways. Please contact us for an RMA (Return Material Authorization) number and correct ship to address before returning any item. Please be sure to include the RMA number on the outside of any returned packages.

From the moment you call for information, when you place an order, when the product arrives at your door, and through the years of product usage that follow, you will be glad you chose to work with Fire Mountain Solar. If we are unable to provide the information you need to your satisfaction, we will find and send you to someone who can.

Limited Warranties:	All new products sold by Fire Mountain Solar are backed by the limited warranties of the original manufacturer only. Consult your product documentation for specific limited warranty information.
Disclaimer of Warranty:	NO WARRANTY OR AFFIRMATION OF FACT, EXPRESS OR IMPLIED, OTHER THAN AS SET FORTH IN THE LIMITED WARRANTY STATEMENT ABOVE IS MADE OR AUTHORIZED BY FIRE MOUNTAIN SOLAR. FIRE MOUNTAIN SOLAR DISCLAIMS ALL WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SELLER'S MAXIMUM LIABILITY WILL BE LIMITED TO THE PURCHASE PRICE OF THE PRODUCT.
Product Suitability:	Many localities have codes and regulations governing sales, construction, installation, and/or use of products for certain purposes, which may vary from those in neighboring areas. While Fire Mountain Solar attempts to assure that its products comply with such codes, it cannot guarantee compliance, and cannot be responsible for how the product is installed or used. Before purchase and use of a product, please review the product application, and local codes and regulations and be sure that the product, installation, and use will comply with them.
No Consequential Damages:	In no event shall Fire Mountain Solar, its subsidiaries or affiliates, or their respective officers, directors, employees, representatives, agents, contractors or suppliers (collectively, "Fire Mountain Solar" ) be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to, loss of use or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not Fire Mountain Solar has been advised of the possibility of any such damages.
Force Majeure:	Fire Mountain Solar shall not be liable for any delay in or impairment of performance resulting in whole or in part from Acts of God, labor disruptions, shortages, inability to procure product, supplies or raw materials, severe weather conditions, or any other circumstances or cause beyond the control of Fire Mountain Solar in the conduct of its business.
Indemnification:	Buyer agrees to indemnify, defend and hold harmless Fire Mountain Solar and its respective directors, officers, shareholders, employees, affiliates, agents, advertisers, attorneys and any third party service providers to Fire Mountain Solar, from and against all losses, liability, expenses, damages, costs, claims and demands, including reasonable attorney's fees, arising out of or in connection with any claim against Buyer including claims by customers and third parties including any claim arising out of the use of the Goods and Products furnished to Buyer. This indemnification and hold harmless shall extend to Buyer's successors and assigns.
Modification of Terms:	Fire Mountain Solar's acceptance of any order is subject to customer's assent to all of the terms and conditions set forth in Fire Mountain Solar's documentation, and purchaser's assent to these terms and conditions shall be presumed from purchaser's receipt of Fire Mountain Solar's acknowledgment, or from purchaser's acceptance of all or any part of the goods or services ordered. No addition or modification of terms and conditions shall be binding upon Fire Mountain Solar unless agreed to by Fire Mountain Solar in writing. If a purchase order or other correspondence contains terms or conditions contrary to the terms and conditions contained in Fire Mountain Solar's terms and conditions, Fire Mountain Solar's acceptance of any order shall not be construed as assent to any additional terms and conditions, nor will that constitute a waiver by Fire Mountain Solar of any of the terms and conditions contained in Fire Mountain Solar's terms and conditions.
Waiver, Choice of Law and Venue:	The failure of either party to assert a right hereunder or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent nonperformance of any such term or condition by the other party. All transactions shall be governed by the laws of the State of Washington, excluding conflict of law rules, and venue shall be in Skagit County, State of Washington.
No Third Party Benefit:	The provisions stated above are for the sole benefit of the parties hereto, and confer no rights, benefits or claims upon any person or entity not a party hereto.
Complete Agreement:	The terms and conditions in Fire Mountain Solar's forms, acknowledgments, invoices, quotations, and website terms and conditions, are incorporated herein by reference and constitute the entire and exclusive agreement between purchaser and Fire Mountain Solar.
